Terms and Conditions

Please be advised that bidding on any item, whether in house, on-line or by absentee bid or telephone bid, indicates acceptance of the terms and conditions announced at auction, advertised and stated here. Any breach of obligation under the terms and conditions of this sale may require Roberson’s Auctions to utilize all remedies available by law to rectify the situation.

Buyer’s Premium: The Buyer’s Premium Online will always be 25%.  The buyer’s premium shall be 25% in house(with a discount of 5% for cash or check in house only) of the final bid price of all sales.

Absentee Bidding: **Must see “Absentee Bid Instr.” page located on this website. When bidders are unable to attend a sale, Roberson’s Auctions will be glad to accept absentee bids. All absentee bidding must be in place by     2 pm on day of sale. The bidder must acknowledge that the condition of the item(s), as described to him/her by our staff, is strictly based on the opinion of our staff. Once the absentee bid is entered, the absentee bidder thereby confirms that he/she is bound to complete the purchase of the item in the event of a successful bid. If duplicate bids are submitted, the first absentee bid will take precedence. Payment must be made within seven days of successful bid notification, if not paid within the seven days your credit card will be charged, no exceptions.

Telephone Bidding: **Must see “Absentee Bid Instr.” page located on this website. Roberson’s Auctions will also accept telephone bids until 3pm on the day of sale, provided sufficient phone lines are still available. We prefer that arrangements be made at least 24 hrs. prior to sale time. We strongly suggest any arrangements for bidding by phone be made as soon as possible. If telephone bidding is executed without the bidder having physically inspected the item(s), he/she must abide by the same conditions as stated in the absentee bidding terms.

Disputed Bids: If a dispute arises, the auctioneer has final discretion to determine the successful bidder or to re-offer the item in dispute. In the event of a tie bid (where floor assistant and auctioneer have called same monetary bid to different bidders) the item will be run off between the two tie bidders only.

Payment Terms: All items are to be paid for the day of sale (excluding absentee and telephone bids, which are to paid within 7 days). Payments accepted are Cash, Cashier’s check, Traveler’s check, Mastercard, Visa, Discover Card, American Express & Paypal, Personal or business check with the understanding that merchandise will be held for check clearance on first time checks, unless a valid bank letter is presented previous to sale       (Call for info.). The purchaser is legally responsible for payment. If you are a successful bidder, failure to complete payment within the time allocated may result in legal proceedings and most definitely will result in non-issuance of a bidding number in the future.

Tax: New York State Sales Tax is charged on any purchase taken possession of/or delivered within the state, unless the purchaser has completed a valid N.Y.S. resale certificate with a NYS number or a valid out of state resale number. The sales tax in Ulster County is 8%.   If shipped out of state, there is no sales tax applied.

Shipping: Packaging and handling of purchased lots is at the entire risk and expense of the purchaser. As a service to the buyer, Roberson’s Auctions will arrange for packing, shipping and insurance with a local packaging/shipping agent (at our discretion).  Large items are the responsibility of the buyer to arrange pickup by a Courier of Freight Co.        All expenses incurred will be paid by the purchaser. We will not be held responsible for recommending or choosing a shipper for the purchaser in the event of any act and/or omissions in packing, nor does Roberson’s Auctions assume any responsibility for damages.

Condition: All property is sold “as is”. Roberson’s Auctions does not make any implied warranty or representation as to the condition of any lot offered for sale and no statement whether written or oral shall constitute such a warranty. We have tried to provide adequate descriptions and  condition reports, we ask that the buyer evaluate all items offered if attending our preview.  We advise all prospective buyers not previewing to request additional photos and/or hands-on condition report at least 48 hours prior to sale.   We will not be held responsible for any errors and/or omissions.

Reference: Where listed, the descriptor “attributed to” indicates that, in our opinion, we believe the item to be the work of the listed author, however we make no guarantee as to the authorship of such a designated work.
